Denying Medical Records
Here are some steps on how to get hospital medical records using India's RTI Act:
File an RTI application with the concerned hospital. In your application, you should ask for information about your medical records, including the following:
Your name
Your date of birth
Your address
The date of your admission to the hospital
The date of your discharge from the hospital
The name of the doctor who treated you
The diagnosis of your illness
The treatment that you received
The medications that you were prescribed
The results of any tests that you underwent
Any other information that you believe is relevant to your medical records
Provide all relevant information, such as your name, address, and contact details.
File your RTI application in writing. You can either hand-deliver it to the concerned office or send it by post.
Keep a copy of your RTI application for your records.
Follow up on your RTI application. If you do not receive a response within 30 days, you can follow up with the concerned office or file a complaint with the State Information Commission (SIC).

In the case of Dr. B.P. Singh v. Union of India, the CIC held that patients have a right to access their medical records. The CIC also held that the government hospitals are required to provide patients with their medical records within 30 days of receiving an RTI application.

The CIC also held that the government hospitals are required to provide patients with their medical records in a readable format.
In the case of Dr. Amit Gupta v. CPIO, Safdarjung Hospital, New Delhi, the CIC held that patients have a right to access their medical records, even if they have been transferred to another hospital. The CIC also held that the government hospitals are required to provide patients with their medical records in a timely manner.
