Land Grabbing
The Right to Information (RTI) Act can be used to address or avoid the land grabbing by public servants or with their help using fabricated land records in the following ways:
RTI can be used to obtain information about land records. This information can then be used to identify potential cases of land grabbing.
RTI can be used to obtain information about the officials who are responsible for maintaining land records. This information can then be used to hold the officials accountable for any irregularities in the land records.
RTI can be used to obtain information about the beneficiaries of land grabbing. This information can then be used to track down and prosecute the perpetrators of land grabbing.
Here are some success stories of how the RTI Act has been used to address land grabbing:
In 2011, an RTI activist filed an RTI application with the Revenue Department of a state in India to ask for information about land records. The RTI application revealed that there were serious irregularities in the land records, including the fabrication of land records. The RTI activist filed a complaint with the Lokayukta, which is an anti-corruption watchdog. The Lokayukta subsequently investigated the complaint and found that the officials responsible for maintaining the land records had indeed fabricated the land records. The Lokayukta recommended that the officials be suspended and that the land be returned to its rightful owners.
In 2012, an RTI activist filed an RTI application with the Revenue Department of another state in India to ask for information about land records. The RTI application revealed that there were serious irregularities in the land records, including the transfer of land to public servants without following due process. The RTI activist filed a complaint with the CBI, which is India's premier investigating agency. The CBI subsequently registered a case and arrested several people involved in the land grabbing.
In 2013, an RTI activist filed an RTI application with the Revenue Department of a third state in India to ask for information about land records. The RTI application revealed that there were serious irregularities in the land records, including the sale of land to private companies at below-market rates. The RTI activist filed a complaint with the Comptroller and Auditor General of India (CAG), which is an independent body that audits the accounts of the government. The CAG subsequently investigated the complaint and found that the officials responsible for selling the land had indeed violated the rules. The CAG recommended that the officials be suspended and that the land be recovered from the private companies.
These are just a few examples of how the RTI Act has been used to address land grabbing in India. By using the RTI Act, citizens can obtain information about land records, identify potential cases of land grabbing, and hold the officials accountable for any irregularities in the land records.
